The obligations of the EU’s Data Act (2023/2854), which concerns smart devices and data, will take effect on 12 September 2025. The purpose of the Data Act is to provide buyers of smart devices with more information about the types of data collected by the products or services they purchase, and to clarify the rights of both customers and device providers regarding the collected data. Unlike the General Data Protection Regulation (GDPR), which came into force in 2018, the new regulation specifically covers non-personal data, particularly sensor data.
As a provider of smart devices and systems, Koja Group will begin publishing product- and service-specific Data Notices that detail the types of data collected by Koja Group’s products and services. As part of the regulation’s implementation, Koja Group will also broadly adopt new data-related contracts and terms for deliveries involving data processing – for example, in remote monitoring and lifecycle services. These terms define the rights of both Koja and Chiller, and the customer, regarding the collected data.
The Data Act will primarily affect new equipment deliveries and service agreements. During the transition period (2025–2027), older agreements may also be updated to comply with the Data Act.
